Legislators in NJ are debating a law that will allow police at the scene of an accident to scroll through drivers' cell phones to determine whether there was talking or texting at the time of the crash, without need for a warrant.

Another point I've heard repeatedly is that if due process is okay for murders and rapes, why does a simple MVA need summary evidence? But apparently the circuit courts are divides on this, so it cant be as simple as I think.

That's true.

Besides, even if it shows that I was sending a text then, maybe I used text-to-speech?

I doubt that it will pass... but that's just a hopeful gut feeling...
